TERMS AND CONDITIONS OF THE WEB PLATFORM “MOBILITY BEHAVIOUR CHANGE”
1. Objectives and features of the platform
Mobility Behaviour Change (hereinafter ‘MBC’) is a web sharing platform (hereinafter the ‘Platform’) that was developed as part of the Interreg Alpine Space SaMBA European Project and is managed and owned by the Links Foundation – Leading Innovation & Knowledge for Society (hereinafter ‘Entity’).
The objective of the Platform is to promote measures and initiatives to change the mobility behaviour by addressing an indistinct group of subjects, such as public administration, public and private entities, commercial companies, individuals.
The Platform consists of three sections within which it is possible to find different areas of interest and interactive features (hereinafter ‘Features’) listed below:
– The ‘Take Inspiration’ section, with the following Features:
- MBC Practices;
- MBC Front runners;
- MBC Research;
- MBC Stories.
– The ‘Co-create the MBC’ section, with the following Features:
- MBC Challenges;
- SEROI+, a Tool for stakeholder analysis.
– The ‘Good News!’ section
The Platform does not pursue commercial purposes. The Platform does not allow the upload of commercial or advertising content. Nevertheless, it is still possible that users will publish content with an advertising or commercial nature. The Platform declines any liability in this regard and the publication of content cannot be interpreted as a recommendation or advice to purchase.
2. User registration
User registration on the Platform is mandatory in order to use the interactive features for content upload (MBC Practices, MBC Front runners, MBC Challenges).
Upon first access, the user will be asked to register for free by filling out the form on the login page. The fields marked by an asterisk are mandatory; it is recommended to fill in the other optional fields in order to make the profile more complete.
Once all the necessary fields have been filled in, the user will receive a registration confirmation email containing the chosen username and the link to confirm the completion of the procedure.
At the end of the registration procedure, the user will be assigned an account and a password. The confidentiality of such information is under the sole and exclusive responsibility of the user and, therefore, he/she will be exclusively responsible for any activity carried out through his/her account by third parties to whom the user has provided the aforementioned identifiers or anyhow came into their possession due to the user’s negligence.
The user agrees to promptly notify the Entity of any unauthorized use of the password.
At the second access, the user must enter, at his/her discretion, the username or email address, as well as the password, on the login page.
The Platform, in order to facilitate subsequent accesses, will allow the user to flag ‘Remember me’ so as not to have to enter the access data every time.
The Platform allows the user to recover the password in case it is forgotten or lost by accessing the ‘Lost your password?’ and entering the username or email address indicated in the registration procedure. Once clicking on ‘Get new password’, the user will receive the new login credentials on the email address provided.
3. Description of the Features
MBC Practices, in the ‘Take Inspiration’ section, is the sharing of best practices of measures, actions and policies in the field of sustainable mobility and change in mobility behaviour.
Viewing MBC Practices content: by clicking on the link ‘Show all MBC Practices’, the user can freely view the publications of their interest, also through the filter function that allows you to search for Practices based on the following parameters: country of interest, type of policy, recipients and means of transport. The search is also allowed by entering keywords in the appropriate box.
Uploading MBC Practices content: in order to be able to upload content to MBC Practices, the user, after registering according to the procedure set out in Art. 2, must access their profile, fill in the form available at the link https://www.mobilitybehaviorchange.eu/wp-admin/post-new.php?post_type=mbc-practice and continue with the upload phase by clicking on ‘Submit for review’.
The content thus uploaded will be subject to control by the Entity on the basis of the requirements referred to in the following Art. 9.
In the event of a positive outcome of the aforementioned check, the content will be published and will be freely accessible within the MBC Practices section. In the event of a negative result, the Entity reserves the right to communicate the reasons for refusal to the user.
Once the content has been published, the user can modify and/or delete it by accessing their profile and selecting the MBC Practice to modify/delete: to modify it, the user acts directly on the form fields and clicks on ‘Update’; to delete it, he/she clicks on ‘Move to trash’, thus moving the MBC Practice to the bin which is automatically emptied every 30 days.
MBC Front Runners, in the ‘Take Inspiration’ section, is the collection of public administrations and organisations, including private ones, active in sustainable mobility initatives and change of citizens’ mobility behaviour towards more sustainable forms.
Viewing MBC Front Runners content: by clicking on the ‘Show all MBC Front runners’ link, the user can view the publications of his/her interest, also through the filter function based on the country of interest. The search is also allowed by entering keywords in the appropriate box.
Uploading MBC Front Runners content: in order to be able to upload content to ‘MBC Front Runners’, the user, after registering according to the procedure set out in Art. 2, must access their profile, fill in the form available at the link https://www.mobilitybehaviorchange.eu/mbc-front-runner-submit-form/ and continue with the upload phase as follows by clicking on ‘Submit for review’. The Front runners will actively participate in the MBC community, publishing MBC Practices and launching MBC Challenges (for which they have the status of moderator).
The content thus uploaded will be subject to control by the Entity on the basis of the requirements referred to in the following Art. 9.
As moderators, the Front runners will have the opportunity to delete the content in violation of the provisions of these terms and conditions and, in the most serious cases, report the situation to the Entity.
If the aforementioned check is successful, the content will be published and will be freely accessible within the MBC Front Runners section. In the event of a negative result, the Entity reserves the right to communicate the reasons for refusal to the user.
Once the content has been published, the user can modify and/or delete it by accessing his profile and selecting his MBC Front Runners profile to modify/delete: to modify it, the user acts directly on the form fields and clicks on ‘Update’ ; to delete the profile, clicks on ‘Move to trash’, moving MBC Front Runners to the bin, which is automatically emptied every 30 days.
MBC Research, in the ‘Take Inspiration’ section, is the collection of reports and studies related to sustainable mobility, aimed at raising awareness and increasing knowledge on the influence of mobility behaviour on the environment.
Viewing MBC Research content: by clicking on the link ‘Show all MBC Research’, the user can view the publications of his/her interest, also through the filter function that allows to search for contents based on the following parameters: type of research, year of publication, means of transport analyzed. The search is also allowed by entering keywords in the appropriate box.
Uploading MBC Research content: the user is not allowed to upload any content, but it is possible to suggest publications related to the area of interest of the ‘MBC Research’ Features by writing to the following email address: info@mobilitybehaviorchange.eu. The publication of the content is up to the Entity.
MBC Stories, in the ‘Take Inspiration’ section, collects the experiences, published by users, that have a positive environmental impact.
Viewing MBC Stories content: by clicking on the ‘Show all MBC Stories’ link, the user can view the publications of their interest, also through the filter function that allows to search for content based on the following parameters: country of interest and means of transport analyzed. The search is also allowed by entering keywords in the appropriate box.
Uploading MBC Stories content: the user can upload the content without prior registration by using the form available at the link https://www.mobilitybehaviorchange.eu/mbc-story-submit-form/.
The content thus uploaded will be subject to control by the Entity on the basis of the requirements referred to in the following Art. 9.
In the event of a positive outcome of the aforementioned check, the content will be published and will be freely accessible within the MBC Stories section. In the event of a negative result, the Entity reserves the right to communicate the reasons for refusal to the user.
Once the content has been published, the user can modify and/or delete it by sending a written request to the email address: info@mobilitybehaviorchange.eu and indicating the content to modify/delete.
MBC Challenges, in the ‘Co-create the MBC’ section, allows the user to interact with the MBC community in order to find solutions to solve the mobility problems of the context in which they live, by launching a public challenge. The solutions can come from start-ups, companies and institutions, which can present their ideas through the Platform.
Viewing MBC Challenges content: by clicking on the link https://www.mobilitybehaviorchange.eu/all-mbc-challenges/, the user, without prior registration, can view all the MBC Challenges and propose their own solutions, which will be visible only to those who launched the challenge.
Uploading MBC Challenges content: in order to be able to launch the challenge on ‘MBC Challenges’, the user, after registering according to the procedure set out in Art. 2, if not already a Front runner, must access their profile, fill in the form available at the link https://www.mobilitybehaviorchange.eu/wp-admin/post-new.php?post_type=mbc-challenge and continue with the phase upload by clicking on ‘Submit for review’.
The user who launches the challenge will be able to upload the relevant documentation and constantly update the MBC community via the upload section about the subsequent phases and the evaluation of the proposed ideas, as well as proclaim the respective winner.
The Entity reserves the right to check the content of the challenge at any time on the basis of the requirements referred to in the following Art. 9 and also reserves the right to obscure the content of the same if it ascertains a violation of the aforementioned requirements.
SEROI +, a Tool for stakeholder analysis, in the ‘Co-create the MBC’ section, allows the user, without prior registration, to be redirected to the web page http://seroi.plus which is an open source tool, independent from the Platform, with the aim of guiding the user in the analysis of the relevant stakeholders for the adoption of a sustainable mobility measure or policy.
The Good News! Section contains updates on new sustainable mobility trends.
Viewing Good News content: by clicking on the link https://www.mobilitybehaviorchange.eu/good-news/, the user, without prior registration, can view all the article previews and access the whole content by clicking on ‘Read more’. The links inserted at the end of the publication allow the user to access the author’s site and other channels with further information.
Uploading Good News content: in order to be able to upload an article, the user, after registering according to the procedure set out in Art. 2, must access their profile, fill in the form available at the link https://www.mobilitybehaviorchange.eu/wp-admin/post-new.php and continue with the upload phase by clicking on ‘Submit for review’.
Once the content has been published, the user can edit and/or delete it by accessing their profile and selecting the Good News to edit/delete: to edit, the user acts directly on the form fields by clicking on ‘Update’; to delete the Good News, click on ‘Move to trash’, moving it to the bin, which is automatically emptied every 30 days.
4. Acceptance of the terms and adherence to the conditions of use
The use of the Platform and its Features implies acceptance of all the terms and conditions set out in this document, as well as the provisions contained in the ‘Privacy’ section of the Platform.
Additional substitute or supplementary terms, conditions and warnings to what is herein provided may be integrated at the discretion of the Entity and possibly specified and indicated in other pages that can be viewed within the Platform, the use of which will imply acceptance of such terms.
5. Changes to the terms and conditions of use
The Entity reserves the right to modify, at its sole and unquestionable discretion, at any time and without prior notice, the terms and conditions of use under which the Features and information contained in the Platform are offered.
The user is entirely responsible for constantly checking these terms and conditions.
6. Links to Third Party Websites
The user will be able to access third party websites, also through referral by the Platform via a hypertext link and is aware that the Entity has no power of control, neither direct nor indirect, nor any kind of responsibility over them and their content or usage.
The rules on the protection of personal data established on the Platform may not apply with regard to third-party sites on which the Entity, in accordance to the previous paragraph, does not exercise any form of control and responsibility.
7. Uses that are unlawful or prohibited by law
The user agrees: (i) not to use the Platform and the documents uploaded on it for unlawful purposes, prohibited by law or contrary to these terms and conditions of use; (ii) not to counterfeit other users or other computer piracy actions; (iii) not to take actions capable of damaging it, rendering it unusable, overloading it, deteriorating it or interfering with the use of the platform by other users.
8. Use of the Platform and Features
The user agrees to use the Features exclusively to send content and materials by undertaking, by way of example but not limited to, not to defame, abuse, harass, threaten or otherwise violate the rights of others protected by law (such as the right relating to the protection of personal data and advertising); publish, post, upload, distribute or disseminate any false, inappropriate, profane, libelous, transgressive, obscene, indecent or illegal topic, name, material or information; upload or make available files that contain software or other material protected by intellectual property legislation (or rights relating to the protection of personal data or advertising) unless the user is the owner of these rights or has received all the necessary authorizations; upload files that contain viruses, trojan horses, worms, corrupted files, or any other similar program or software that could affect the operation of other computers; advertise or offer for sale or purchase goods or services for commercial purposes for purposes other than the objectives of the Platform and to the extent that this is strictly necessary; download files sent by another user that cannot be legally reproduced, displayed, executed and/or distributed in such ways; falsify or delete copyright management information, such as an author’s name, special or legal notices or proprietary designations or origin labels or the source of software or other material contained in a file that has been uploaded; restrict or prevent other users from using the Features; collect or gather information about other users, including e-mail addresses, without their consent; violate any code of conduct or other guidelines that may be applicable to a particular Feature; create a false identity in order to deceive other users; violate any law or regulation.
The Entity retains, at its sole and unquestionable discretion, the right to: (i) refuse to publish the content that users request to upload in the Features; (ii) cancel, modify, censor, even partially, such content; (iii) interrupt the user’s access to one or more Features; (iv) disclose at any time any information deemed necessary to comply with applicable laws, rules and regulations.
The user must not provide data, information and images that allow the personal identification of other persons, including subjects under particular legal protection such as minors and persons subject to protection and/or curatorship, unless expressly authorized in writing by the latter and/or or their legal representative.
The purpose of the Platform is to encourage the dissemination of good practices and therefore the content uploaded by users must be able to be made freely accessible to other users of the Platform.
9. Absence of guarantees
User publications on the Platform are not to be considered exhaustive or commitments to obtain results.
The Entity may in no way be held responsible, either directly or indirectly, for any action taken on the basis of such publications.
10. Limitation of Liability
In any case, the Entity may not be held responsible for any direct and/or indirect damage resulting from the use of the Platform or other websites connected to it via a specific link.
11. Indemnity
The user agrees to indemnify and hold harmless the Entity, as well as its employees and collaborators, from any compensation obligation towards third parties arising from or in any way related to the use of the Platform.
12. Personal data protection
For the provisions on the protection of personal data, please refer to the section https://www.mobilitybehaviorchange.eu/privacy/ displayed on the Platform home page.
13. Final provisions
The terms and conditions of use of the Platform are governed by Italian law. For any dispute that may arise on the interpretation of these or following the use of the Platform, the Court of Turin is competent.
Unless otherwise specified, the contents must be written in English. The Entity does not use specific translation tools in the case of publications in other national languages, referring to the browser’s automatic translation system and with respect to which it assumes no responsibility for compliance with the original text, entered by the User.
The user acknowledges that the publication of content and images is not suitable for establishing any joint venture, association, employment or agency relationship with the Entity.
The invalidity, voidness and/or inapplicability, even partial, of one or more of the aforementioned clauses will not affect the remaining terms and conditions which will continue to retain full validity and effect.
